I think what you are asking is if you are allowed to re-apply for the visa. That is what it seems like. If that is the case, here is my answer. The US Embassy never prohibits people from applying for the visa. You can apply as many times as you like, even if you keep getting denied. The reason it is suggested that you wait to reapply is that the cost is so much that you wouldn't want to waste your money if you were just to get denied the visa again. This is why they suggest that you don't reapply until your case has changed. So, my suggestion is to go ahead and reapply if your case has changed that significantly. You have to go through the entire process again, but this time write a letter and attach it to your application that explains why your case is different. If you choose to do this, your interview will be with another officer and you will have a fresh chance. Be sure to prove that you now have custody of your daughter and that you have a job. There is a chance that you will be denied again, but if you feel that you have a good chance of getting approved, go for it! Hope it helps [and that this is what you were talking about...]
