Is it because the jails would be full? I live in a town called MethCalester. It's really McAlester; but with most the drug users in this town making meth in their homes it has that nickname. My neighbor is hooked bad and when he hits his girlfriend in my yard I call the police. They do nothing. At first I thought maybe he's a snitch for them. Or maybe some of the local police are corrupt and don't want to take in their supplier. I work at a prison and I called to see if they heard anything on the scanner. They said the police were laughing about how he couldn't be still and how he had to be on something. By the way the lady is dead now.

In Ontario Canada the law we use to arrest people who are drunk in public is called the Liquor Licence Act. It gives us the authority to arrest someone drunk if they are a danger to themselves. It specifically states the person must be intoxicated by alcohol. We have no authority to arrest anyone for being high on drugs alone unless they are committing another criminal offence (possession of drugs, causing a disturbance or assault, driving a car while high etc.)
I'm curious to see if this applies elsewhere as well.

Mainly the whole burden of proof thing. There is no actually way to prove in court that the person is actually high or not. Even if they took a blood sample, it would not hold up cause the toxicology will remain positive for several days past the use of the drug.

there is a law against drug abusers everywhere. if anyone is caught using the drug in public they can be taken in. also if they are caught carryng or selling or producing the drugs they can be arrested. it is also against the law to beat his girlfriend whether he is high or not. it is considered criminal for any type of abuse to occur. if the cops ignore the abuse you can usually file a complaint to the police department about the particular police involved in the situation. if that doesnt help u can also complain to the Independent Police Complaints Commission (IPCC) which deals with only complaints to police officers and also is separate from the police officers. they can usually help.

Now how many people do you see everyday and think to yourself " That person has to be on something" the cops would be checking everyone on the street. Every time I see a kid wearing his pants around his knees I think " this guy must be on something" or what about the cashier who can't give you change after you hand them a 5 and the bill is 3.87 seee the point?

In California, they can. Health and Safety Code section 11550 says that being high is a misdeamenor. Moreover, it has a 90 day minimum so you go to jail for at least 90 days. You don't have to be high in public either.

burden of proof.they dont have drug breathalizers,for all the cops know you could be making this all up.
