... allegedly won't or can't afford to comply with basic Health and Safety issues for its Military Organisation (ie MoD) as any other civilian organistations have to comply with, such as basic equipment in good order to get the job done, as well as having enough staff to do the job safely so they get proper rest periods for instance.. (and I DO UNDERSTAND that those same rules do NOT apply in the theatre of war !!!), nevertheless, the UK MoD do have Home Regiments, and other Military personnel all over the world not operating in theatre of war scenarios.. and it's been well publicised recently the conditions they have had to work and operate under, yet I have not heard of the MoD - or for that matter, Her Majesty the Queen as the Ultimate Commander of Her Forces being sued for breaching basic Health and Safety rules in Her/thier Organisation.

I'm sure someone will give me an explanation as to why not, which I will find very interesting in this "Open Government" of the day.

As I understood things I believed there was such a thing as "duty of care..." somewhere at the top of the Health and Safety Rules and Regulations...?

Oh the MoD CAN be sued.. not easy I grant you BUT it can, and indeed HAS been achieved on several occassions !

If i recall correctly, members of the British forces can NOT sue either their commanders or the MOD..nor can they go on strike.

Basically they get stuffed............

and with regard to not being able to sue / strike its in the queens regs and the contract you sign...............at least I am SURE it was pointed out to me that way.
