My neighbor lives in the floor below me. My neice and two kids live with me. I would understand if they were running a lot but there have been a few times when we are all sitting down watching a movie and my neice (20 months old) is the only one who is walking around. My neighbor starts banging on the ceiling of her apartment. Plus, the apartment manager and her are friends so I keep getting notes on my door about the noise. The manager will say I have a leak in my apartment (which I don't-it's just an excuse to get inside to see what going on and who's there). I feel like they are just both harrassing me. Then the neighbor called my boyfriend a n*****. She said it in spanish one day. She was looking out the window when he came to pick me up. My boyfriend speaks fluent spanish, by the way but she didn't think he would understand her. They got in a fight the cops showed up. Then the manager fined me $75 for fighting. Help!

Believe it or not. It's easier for tenants to give landlord/management a hard time than the other way around. Don't pay the $75 fine and there is nothing the manager can do about it. It's not that easy to evict a person. It's a lengthly court case, taking months if not years. When they knock on the door, don't let them in. Only let cops in with a search warrant. Tell the people below you, the next time they bang the ceiling, you'll bang the floor. The manager can't demand to enter your apart without a pre-arranged appointment (except emergency). Otherwise he'd break the law. Threaten to take him to court.

Sounds to me like the landlord's friends down there want your apartment, and he's going along with their tactics. The advice above is right, in that the landlord can't just waltz in, claiming you have a leak. Who said? -The downstairs tenants? All you have to do is tell him, through a partially opened door, that no, you don't have any leaks. Even if the landlord also serves as the maintenance man, you still don't have to let him in for every flimsy excuse like "a leaky pipe." Except for an emergency, you don't have to let him in at all, and if he forces his way in, you can have him arrested for trespassing. Sure, this can lead to an eviction, but then again, it takes months, especially if you've been paying your rent on time and he really has no grounds for it. When the police come to your door, just inform them calmly that no, there's no unusual noises here, and the downstairs tenants are just trying to make trouble. The cops have seen that many times before, and will understand. They can't do anything really, unless they come and hear the noise. JUst don't get into an argument with them, and you'll be okay there. They'll also make a note of how many times those neighbors call them on false alarms like that, and pretty soon come down on THEM.

I know how you feel. We had some neighbors that constantly called the police on us b/c of the type of dog that we have. Luckly the cop that showed up knows us and our dog-so nothing happened. Plus they were always looking out the window at us. I would go to the police one day when you have free time and tell them what is going on. If you can jot down dates or times and what has been said to you by the rude neighbors. Ask them for advice. They will see that you aren't as bad as the neighbors make you out to be and maybe be able to put an end to it. Good luck-I know exactly how you feel.

If you want to fight, read over your lease and then take it to a lawyer. That's probably a long shot, so the best advice is to move out. It's better to live somewhere you're wanted or they don't care than somewhere they care too much and in the wrong way.

Then start calling the police every time you hear your neighbour moving about or better still move apartments it sounds like the landlord is trying to get you out for whatever reason that they might have it is not worth the hassle putting up with it

Get out of there... The people are never going to give you a minute's peace... Assholes are to be avoided, life is too short... Cut your losses and find a friendly place to live...Good Luck

You might have to move. Kids scampering about above your head is unsettling. Perhaps, you could be on the ground floor?

You may want to find another place to live. Sounds like they may be trying to drive you crazy enough to move anyway.

We had a similar problem.
We moved out. Problem solved.
People like that , don't have nothing else to do, they are too
bored w/ their own lives.
