he was to small to defend himself and already told her not to do that but I got arrested. Not Right is it?

2 wrongs don't make a right. You hit someone to the ground and yes, you deserved to be arrested.
Besides, why would you want to stay with a woman that slapped your child.

Now, I don't really believe that any of this happened to you. You just want to get people to respond to your silly post. You want to get women to write and tell you how horrible you are and evil.

OK, Just for the record, if this happened or not is irrelevant, the answer remains the same for those out there who need an answer to this situation. Hitting your spouse, definitely not a good idea, yes, you will go to jail, fair or not. Sad situation is...Now, you have a record of battery or domestic violence so if you do decide to leave her, guess what, she has the better chance of getting the child... OOPS!!! That is what sucks for everyone!!! Get a lawyer, contact DCFS, and play your cards the right way from here on out. IE..Pick up child, take immediately to the ER or Family Doctor so that a legal record of what happened is on your side, then talk to the police, then follow recommended procedures.

Unfortunately that is the law. And with you being the male in the situation you are more likely to be arrested for domestic violence than the female is in the situation. Yet another reason why double standards suck.

Make sure that you either get or have the judge appoint you a lawyer and make sure you explain in detail what happened as a part of your defense. Then you need to think long and hard if you want to stay with her or end it. If you want to stay you need to insure she gets help for her lack of anger management.

Sometimes if one parent calls what ever their child services dept is and informs them of the other parent they can step in enough to make the other get help. Also by them being involved she should be afraid to hit him again, since she knows they are watching her every move.

No. If your wife had *already* slapped the child, then you are not justified in hitting her to defend the child. What you describe is retaliation, NOT defense of others. Although I understand where you're coming from, you could be liable for battery. To act in defense of another, you must act *before* the harm occurs.

Also, hitting a child's parent in front of the child isn't good for anybody

Hitting your wife is not right, first of all.
I have to say, I was slapped in the face many times as a child. It's not really punishment, it's more like getting your attention.
Secondly, being slapped in the face has never killed anyone. (If any of you know of one particular instance go ahead and name it WITH details) It's punching people very hard and with blunt or sharp objects that does more damage. I've never seen someone with a black eye or bloody face because they merely got slapped.

In most, if not all, jurisdictions you can use reasonable force in defense of others, but "slapping [that is the way it is spelled] her to the ground" does not sound reasonable. So she committed a battery on the child (a crime), which was followed by you committing a battery on her (another crime). You can argue whether or not she should have been arrested as well, but you have no beef on your arrest.

If this is indeed true, you both should have been arrested for domestic battery. You, for slapping your wife, and your wife, for slapping your child. Two adults doing the slapping.....with the true victim being the child in the long run.....very sad !!

It depends. Was it necessary to slap your wife to the ground to stop her from slapping your child? Could you have simply placed yourself in between the two and got the same results? Did she hit your child one time or was she continually beating your child?

no it is right. its domestic violence. the parent has the right to disaplin their child if the child is hit with a open hand instead of a closed fist. but i think that mainly is for spankings on the bottom... during a domestic violence in the state of washington someone IS going to be arrested if not both of you

to be frank she should not slap a child round the face however you should not have hit her 2 wrongs don't make a right. try counseling on how to deal with behavior. i do hope that you can both work things out good luck.
