Everyone has been super informative. Ok if you haven't read my other questions, I"m dealing a situation where my boyfriend fathered a 5 month old son (yes dna test was given) the mother is on welfare, has one 5 year old son, and is now pregnant with twins, she will before the birth be married to the father of the twins. If my boyfriend decides to sign over his rights, I know the child support payments will continue, though if her new husband adopts him (which was an option given to him by the mother) will that change the situation?

Thank you for those giving me thier personal experience. For those who question my boyfriend's judgement on the situation. It would be best for the child to be in a FAMILY, his mother is getting married she's 20 and a mother of 2 (4 in like 8 months), her new bf/fiance is the mother of the twins she is carrying. My boyfriend and her didn't have a relationship, and he wasn't aware of the pregnancy until AFTER the birth. It is not something he is ready for, and is trying to look out for himself as well as the baby, being he knows he doesn't have the means to support a child. He's keeping his options open and trying to figure out the best solution.

If her new husband adopts the children then the child support would stop. Although, that is a strange situation. Why would a man WANT to give away his rights to his children. That is a big negative message sent to the children that he can never undo. B/c of the child support? A sorry man who won't pay child support, I can understand, but a dad who works hard and shows this children (no matter how young) that he wants to contribute to their well-being is proving (for a lifetime) that he loves and genuinely cares for them. The new step dad will not benefit (love nor money) from adopting, unless the birth father is a good for nothing sorry man and doesn't want any relationship with his own children. Then the step dad will be promising to love and care for them forever, even he should divorce the mother. Alot to think about....

If there is an adoption by the new husband...the child support stops! The father cannot just sign his rights away unless there is an adoption going to take place. They call that bastaring a child. Also, if adoption and signing rights away takes place...he will not get visitation either. The birth certificate gets changed and everything else.

Yes, usually once a father signs over his rights and someone else adopts the child, the real father is no longer responsible for child support. Could be different in every state though, I'm not sure.

Please Check with the state you live in. Each state has a different spin on this and while the answers you have received may be correct for their states it may not be correct for yours. Child support is for the CHILD, and its the child's interests and well being everyone should be watching for. Bottom line he is the biological father and will be so for the rest of the child's life, even after the child is grown. I would work out a deal where he will sign over his rights, but with visitation priviledges. Support or no. The CHILD will want to know his real father one day, not because he won't love his step father, but just out of natural curiousity of who he is. He may need him for medical reasons etc.

Not sure of your particular state laws; however, if the new father adopts properly through the courts, giving your boyfriend's child his last name, then that means no more child support for your boyfriend. BUT, it also means your boyfriend has absolutely NO rights, including visitation, etc. Think before you act.

From what I udnerstand if the child is adopted then the support payments end. You may want to check with family services to find out for sure.

In Colo it does. If BF gives up parental rights and her new hubby adopts the baby, then new hubby becomes responsible for that child. BF will have no more rights, nor child support payments.

yes. the support payments will be terminated. but why would he want to do that. he made the 5 year old not this other man so he should take care of his son. i think what you should do instead of asking us all these questions is stand by your man's side and tell him to be a father to his son. no other man should have to pay for his child.

generally, yes, but it really depends on what is put in the legal documents. It would be as if someone unknown adopted the child. He would not have any rights to see his child again either.
