Cell phone. The same problems, inattention and slow reflexes are common to both, but a DWI knows he's impaired.

I saw a show that compared these two and they were very close results. Drunk driving was worse but only by a little bit. They put cameras in the car and also recorded eye movement when on a cell phone, when talking on the phone people only looked in 1 or 2 spots to see the traffic, people etc. compared to looking 20+ times when not talking. Drunk drivers were more likely to try to find a car to follow and ended up causing an accident by following too close or falling asleep.

Good call. Actually, driving drunk is worse due to the fact that your actions/reactions are slower than norman, as well as good judgement. The biggest thing about talking on cell phones is they distract the driver, not only while trying to operate the darn things, but some people tend to forget they are driving a vehicle, and lose all sense of safety .
But I would ultimately say that, standing in the road between an oncoming drunk driver and another talking on a cell phone, your pretty much scr*wed!

A study at the University of Virginia concluded that the reaction time of people driving while talking on the phone was TWICE that of people driving drunk. A "hands free" cellphone made no difference, and they determined that people on the phone are simply not giving enough attention to what they're doing.
I think anyone on the phone should be pulled over and have their license taken away just like a DUI. You have been given the responsibility to pilot a 2-ton lethal weapon, and your license is a legal document that you signed which claims you understand and will follow the law and drive safely.

I was rear-ended by a drunk driver exiting the north tube of the Lincoln Tunnel westbound. One of the 2 lanes of the tunnel were closed to traffic. The other was bumper to bumper. The drunk decided that the empty lane was his own personal freeway and when he came to the end, he discovered he had nowhere to go but up my butt. Fortunately, I was driving a 1972 Dodge Coronet and he was driving a little Z car. Their car went underneath my car. My gas tank was crushed and gasoline was all over route 495, but it did not explode. Both the driver and the passenger hit the windshield as they were too drunk to bother with seatbelts. They emerged from the wreckage covered in blood. This has never been done to me by someone using a cell phone. In fact, I don't really see the difference between using a cell phone in the car vs. eating in the car, fiddling around with a radio or CD player, putting on makeup, combing one's hair, etc. Drunk driving is far more dangerous. I think both are equal because the person on the cell phone isn't paying attention to their driving. I see this many times as drivers come to a quick stop when I am crossing in the crosswalk. They are so busy on their cell phones that they don't see the light turning yellow.

I would guess a Drunk but the people that do not use HANDS FREE PHONES WITH HEAD SETS ARE STUPID AND DANGEROUS.
NONE OF US ARE SO IMPORTANT THAT WE HAVE TO SPEND SOOOOOOO MUCH TIME ON THE PHON.
