I know it's time to quit and I've been delaying the matter for too long. I made some stupid mistakes, and im focus'd on trying to get out of the system. They didn't suspend jail time, I cut a deal with the state attorney. They offered that If I pleaded no contest then i would get 18months probation and 50hours community service. Now 7 months in I fail a probation drug test. Positive for THC. I did recieve a felony from my charge. The judge agreed to withold adjudication upon completion of my probationary period. Any thoughts on the chance of me going to jail?

My charge was Felony Possession of Marijuana over 20 grams.

Chances are good that you will not, however it depends on recommendations of your probation officer.

A failed drug test is still a failed drug test no matter how you slice it. Whenever you violate the rules of your probation, there is always a chance that you may go to jail.

Sorry to tell you but the 18 months probation means that you DID receive a suspended sentence. Anytime you are put on probation it means that you have received a suspended sentence. That's one of the biggest differences between probation and parole. Probation is the suspension of the sentence and Parole is for those people released from prison. When you violate your order, the sentencing Court can impose any time that you have left on your sentence. So in your case it looks like there is a possibility of 11 months jail time.

First realize that some people are lucky when it comes to cops/courts, and some are not.

You my friend, are not.

You have to quit today and stay quit, no f*ng around. You have gotten 2 chances, they won't give you a third.

Then, get ready to kiss some major *ss with every court employee you deal with. Become Mr. Prim & Proper and act like you deserve the chance.

Do your community service as quickly as possible, don't f* around with it. Pay any fines the same way too, even if it means working 2 full time jobs, suck it up.

No matter what it's better than jail.

Trust me on this, I know human nature, and I know that your p.o. will violate you as soon as look at you at this point. I hope you realize that not only do you look bad for failing the test, so does your former p.o. Kiss his butt hard.

YOu might have had a better chance if you were not using the same drug that you got the felony charge for being involved with.
If I were a betting person, I would think that you should bring a toothbrush to your next court hearing.
