I was the primary signer on the loans, however I did not know my husband traded these vehicles. Is this legal for a car dealership to do?

I depends completely on the wording on the loan agreement...but typically it's unlikely that it was a "clean" sale. (I'd say it's UNlegal if not ILlegal.) If the trade-in hasn't been paid off, there's still a title lien against it from the loan company. The car dealer can't (legally) own nor sell the car until the lien is satisfied.

Anybody can pay off the loan on your behalf...maybe the car dealer or your husband paid it off and is waiting for the paperwork to clear up.

It depends completely on the wording of the title (the loan(s), if any, are a different animal).

If the title showed you guys as "Priscilla OR Dufus McGee", for example, there is nothing you can do about it, as it is perfectly legal. If, however, the title was taken as "Priscilla AND Dufus McGee", then you have a valid gripe...and whomever signed the title over at the dealership is in a world of hurt.

was his name on the title? Did he co-sign the loan? If yes then yes to the dealership

Whoever signed your name on the loan papers (if it wasn't you) can go to JAIL. That is FRAUD. If the dealership knew about it, it was fraud on their part also. But the question is, do you want to send your husband to jail?

I guess it would be legal or else the dealership wouldn't have been able to do it.

yeah, they can take anything in trade for a vehicle, all they do is park it in the back lot, and sell it at the auction
