ok here is the situation: i know somone who has come into the usa and married an american so she can get her green card ... she only stayed married to him for three months but still went to the immagration interviews with him under false pretence .. she was also pregnet with another mans baby at this time and told them that is was her so called husbands baby which was not the fact. now she has kicked out the real babies father and is with another man and divorced from the man she married to get into the usa .. my question is .. if the babys father goes to immagration with this information does the baby get taking away from him and she goes back to her country with her mother? or does the father have the right to keep the baby in the usa and yes the baby's father is an american born and raised in the usa .

According to the way it works at this time the baby is an American citizen And the father needs to make sure this trash is deported and he gets the baby.I hope he gets the baby ASAP.

If the baby was born in the US and the father lives in the US, the baby can stay with the father when the mother goes back to her country.

The woman and the first husband are both in violation of Federal lLaw because of the lying on a Federal document. The child will go where family court decides is the best suitable location or family. If you are the first husband you had better hope this is not picked by the Federal authorities because you will be in just as much hot water as she because you were the host in the beginning and failed to report any changes in the marital status as required Federal Law when sponsoring someone into the counrty.

If the father gets legal custody, than the baby would remain with him. Considering all the info you provided, if they can prove all this, than he might be able to show that she is unstable and should not be allowed to take the child out of the country. Good luck to him, sounds like she is a piece of work.

This is really a family law question as much as an immigration question. If the mother is found removable for marriage fraud, then the fight would be over custody of the child. That's something that would be decided in family court, not by the immigration service.

Or you (they) could solve the whole problem by not violating the immigration laws and coming into the country like most everyone else's ancestors did, legally Good way to start being a law abiding citizen is abiding by the immigration law instead of looking for loopholes like a purse snatcher on trial.
