Quite to the contrary to what some claim, it is not a soldier's duty to follow orders no matter what. That ceased to be an excuse at the Nuremberg trials, and given how many Americans died to make that point, it is plain and simply revolting that some here believe a soldier should rape, pillage, murder and torture without hesitation when he is being told to do so.
An illegal order is an illegal order and per definition not binding since the one giving it lacks the authority to give it. Article 90 of the UCMJ specifically states that the duty to obey an order concerns lawful orders only. Explanation 2 a i specifically states "This inference does not apply to a patently illegal order, such as one that directs the commission of a crime."
If this attitude -which comes natural to every CIVILIZED soldier- was more widespread in the US forces, there'd never been Abu Ghraib, there'd never been a Haditha massacre and there'd never been a whole lot of other incidents which only served to drive more people to join the insurgency. The attitude some people here depict kills American soldiers. And it's a pity that they boast with it, pretending it to be good for the troops. It is not. It is a disgrace, a testimony of being mentally stuck in Ypres and in Baby Yar.

definite. Iraq did no longer do what become required by applying the UN ending the 1st gulf conflict. The occupation and employer of a clean government is likewise criminal. that's a central authority consultant of the inhabitants of Iraq no longer a puppet or shadow government. Freely elected and with the subsequent substitute over on the subsequent election they are going to understand democracy

well he knew what he was doing when he volunteered to join the army.he went in the military to get a paycheck and benefits because he prob has a degree in something useless and could not find a job in the states that paid more than $30k a year.
he faces 4 years, i think,in leavenworth.i hope he gets it,loses his rank,and gets a dishonorable discharge.
then lets see what kind of job he gets after that.
he is just a yellow bastard with no backbone.
i did not run when i was in the military during desert storm.
i proudly did my time and got out after 4 years and an honorable discharge.

Absolutely. The "war"...if you can call it that....is illegal. We went in before congress approved, and when they finally did approve they did it based on a pack of lies and bad intel. And against the will of the U.N.....which the U.S. led in forming specifically to prevent situations like this from occurring.
Open your eyes people.
Props to that solider for standing up for what he believes is right. Like the fellow mentions above..blindly following a leader into war is exactly what the Nazis did...

All we have here is somebody who places his politics above his sworn duty to the nation. Hope he gets to spend several years in Levanworth.
The war in Iraq is legal. If it were illegal then somebody would have gone into Federal Court and had it stopped.
All of the 'illegal war' stuff is simply BS. Something can only be illegal if it violates an actual existing law. Somebody's political opinions do not make any particular act 'illegal'.'

Oliver H misses the point. The guy will get hammered for missing movement. His commanding office did not tell him to mortar a nursurey school or shoot a civilian. He's a pussy pure and simple. Shouldn't have joined if he's not ready to pull the trigger.

i can't say i agree with him. he may be right and able to proveit,but right or wrong the military won't allow it. it would open the door for more.
