an sent me a replacement. but this one is also totally useless, i have e-mailed this person several times but as of yet i haven't received a reply. what are my rights.

Cheers for your answers can i ask another question. The guy now has responsed by saying he will change phone but i got to send other one back, do i have to pay the postage, as i feel that i shouldn;t as i paid a tenner for this item and it is not my fault it is faulty.

If you paid via paypal they will try & sort for you, they sorted a problem for me & I got a refund in 2 weeks or contact ebay customer services they may be able to help

If the seller is reputable he will reimburse you for the postage since the phone was defective. Why not ask him what his policy is? If you are not happy then leave a negative rating

actually paypal are not crap they are good, someone had frauded me twice (not once but twice) and with a high amount of sums, and by two different people on two different dates, and i reported it through paypal (filed a case) and then they refunded me however much they could take out of his/her account...
file a case through paypal if you paid through paypal for the good, and also do what the other member recommended - file a dispute on ebay.... or request information of the ebay member (you will have to send yours in order to get his) and then go to his house and threaten him...

i can safely say you have learnt your lesson the hard way never buy anything of ebay unless its pay pal protected and contact ebay explain the situation also you MUST write a bad reveiw on the companys account to warn all other ppl

im not sure of your rights because ive complained to ebay a few times and nothings come of it-you can pass your details on to them and hope that when the seller recieves the message they will act on it-must warn u though e bay seem a waste of time when it comes to stuff like this-good luck`

Go back to ebay, and report it, they are normally good at sorting it out, good luck.

Report it through e-bay, their dispute resolution center is pretty good(normally).
