How could I prove I didn't damage the item myself? I have only worn the item once?

You can sue in small claims court for the value of the dress when it was taken in. The value will be something like the original purchase price less something for deprecation due to you wearing it.

This is not a legal matter, it is a manufacturer matter. I have wrote before about this. 90% percent of the time when a garment is damaged in cleaning it is a manufactures defect. 85% percent of Dry cleaner do not know how to explain this to the customer. That is why customers think legal action is the only way. 5% of cleaner will explain it like this.

If they label stats Dry Clean only and it was done as per the care label take it back to they place of purchase. You are entitled to at least a store credit. Never return it for the same thing. It does not matter it it is a $10.00 Walmart special or a $2,500.00 Gucci suit. When a issue like this happens at my store I call the store were the customer bought it to get the process started. So when they go to the store they do not get the runaround. Be-were some employees of the store where you bought will say we can't do anything it the cleaners fault. Ask for a manager. This is why it pays to use a quality cleaner they will help you understand and help you solve this problem rather then being part of it. Good luck hope this could help.

Is the dress 100% silk? Was this the first time you dry cleaned it? Stupid question, does the tag say it is OK to dry clean? Sometimes fancy clothes say "do not dryclean" because of special dyes, patterns, buttons that can melt, etc.

There could be several reasons the dress has lost its rigidity - sometimes clothes are starched and are stiff when you first wear them and then are softer after the first washing.

Look at the dry cleaner's receipt and policies. Go back and explain your problem and see what they say. A lot of times there is a sign that says "look at the clothes before you take them home", and that is a legal policy that no one ever follows - even me - but by checking your clothes before you leave, you can save some trouble.

Sad to say you get what you pay for sometimes - my local $1.00 dry cleaner gets my cotton work shirts and cheaper dresses, the expensive dry cleaner gets my fancy dresses and silks.

Good luck!

Check the label. If it is dry cleanable it will be marked with either an "f" or a"p" in a circle. The f is flueroethylene which is a gentler detergent than P which is perchloroethane.Dry cleaners don't all use the same detergent and should check the label before accepting the garment. This is a possible reason for the problem.
Even if it is something else it is worth complaining as they have insurance to cover these things. If they did not warn you of this eventuality you have a just claim.
All the best.

The loss of body is usually caused by the fabric enhancers used in manufacture not able to with stand the cleaning process. If the garment has a care label which states that it can be cleaned then you have redress against the supplier. most pulls on silk are caused by jewellery, rings bracelets etc catching and a lot of retailers now disclaim this by additional warnings on the care label.
Discuss options with your cleaner, they will help you resolve the problem.

Your issue is an example of why people need prepaid legal services. You would be able to send them pictures and they will take care of it. I know a lot of people who have prepaid legal, who this happened to, and got refunded completely, for close that cannot be replaced. That may help. Let me know and I can send you a link, so you can get information.

yes.if you can prove they caused the damage you can most certainly sue them,to cover the cost of the dress at least.
