ME and my ex broke up 4 months ago, now she claims thats she is pregnant with my baby. Now 2 days after we broke up she got together with another man. they've been together for the 4 months that we broke up. So,1.) How much does a blood test cost to determind if im the father or not, or can i wait until the babys born. 2.) What do i have to do to get my name on the birth certificate. And 3.) What do i have to do to get custody of the baby, she has no criminal reports of drug use, but i know she's using, will the courts make her take a drug test, and how can i bring it to the courts attention so that i dont have to have the mother of my baby using illegal drugs while pregnant?

If you can get proof that she is using you can sue for custody. If you let the state handle it they will put her in rehab and give ther the child back when she gets out. It is almost impossible for a father to get custody of a small child especially an infant. If she says it is yours and wants child support you can contest it as she is dating someone else and the two of you were not married. If you are the father you have every right for visitation but you will pay child support. If she says she does not want child support I guarantee she will change her mind sooner or later. If the court orders the paternity test you pay around $200. If it is not yours you get your money back. If your parents want to help you get custody then take them to talk to a lawyer.

DEFINATELY consult a lawyer about the types of documentation you will need to address her illegal drug use. Try to get those as soon as possible to help first and foremost your unborn child and to help gain parental custody.

Since you aren't married, there is a form that has to be signed and notorized placing a father's name on the birth certificate (at least in CA) my boyfriend and I had to go through that with our son. (Some people think that just because we aren't married we're stupid punk teenagers- WHATEVER! neither of us BELIEVE in marriage because both of our parents have been married many many times. Stick up for your rights, protect your child, and tell the haters off.)

Its best to test for paternity after the baby's born, its cheaper and safer on the infant. I'm not sure on the costs, it differs from clinic to clinic. If there are lawyers involved before the birth and you have a substantial case, ALL of the best available means to take care of your child (childcare such as live in nanny/parent, nursery in its own room with the essentail furniture, clothing, diapers etc etc), sufficient income, and a pediatrician all lined up; there is no SANE reason why the court would pass you over as custodial parent. It may all sound extreme, but its worth it if you really want to give the best care to your child. If you're lucky, she'll owe you child support.

It'll be a tough road full of tears, lots of money (unfortunately), and strife. But if you win, you'll gain so much more in return. Good luck and I wish you (and your baby!!) the best.

yes, you can take her to court for a paternity test and for a drug test for her. most likely they will make you pay 50/50 and if its not yours then she will have to reimburse you for the other half. its cheaper and safer if you wait till the baby is born before you get the paternity test. also you may see that it looks exactly like you or this other guy and it might not be neccessary. face the fact that she may be telling this other guy the same thing.
the test is normally like $300 but it costs a lot more if done before the baby is born.
normally whoever is there that signs the birth certificate as the father is the one who has parental rights. so if this other guy signs it and your the father then you will need to go to court. also, don't sign it until you are sure because if its his and you sign it, you'll have to pay child support.

ok i don't know how much a blood test would cost to find out if you are the father or not but if you want the lady to stop using drugs yes the courts can make her take a drug test and how you get the courts invovled i don't know exactly but a good first step would be to ring the cops and tell them that your ex is using illegal drugs you can add in that she is pregnant but i don't think that will have any effect at the moment just ring the cops and tell them that your ex is using

DNA test will run anywhere from $100-$200. You may want to get one as soon as the baby is born just to confirm paternity. If she is using drugs and receiving any assistance from Department of Family Services (food stamps, Medicaid) you could raise a big fuss to them and they could require her to take a drug test. If you are the biological father, getting your name on the birth certificate may take proof (DNA test). Also, you can take her to court immediately after the results to petition custody. Document everything you know about her drug use, and be prepared to hire an attorney and spend lots of money. I hope you succeed, any woman who uses drugs or alcohol during pregnancy does not deserve their child.

You need to talk to a lawyer. If you are lucky, you can get the courts to order drug testing and a paternity test.

You may want to contact a lawyer for a free initial consultation and go from there. I hate to say it but I am seeing too many cases of kids getting pregnant with out being married come on make a commitment before you jump in the sack, kids are not a game and they are the ones who suffer for our stupid hormones and lack of self control.

In most cases you can compell her to have a paternity test.

If the baby is yours it can be conclusively proved, in which case you will have parental rights.

See a lawyer.

If it's your baby, you do have rights. I'm not sure how it would work in your area, but you should talk to a lawyer. If money is an issue, seek out legal aid.
