When the other guy who hit me complain to the police , the police told him its his fault because he was not in the right of way , I was. So whether he hit me or I hit him - he's at fault the cops said.

First of all, the cops do not make liability decisions. Everyone thinks that, but it's not true. They don't determine fault for a civil matter, the insurance company does. Secondly, it's good to supply it, even though it is seldom what determines liability. The insurance company uses all evidence, which includes statements taken from everyone involved and witnesses, and seeing vehicles, etc. You can give it to them, but it won't be the only thing that's considered.

The report will help, but the police generally do not determine fault. Most police reports simply gather & report information. In serious accidents a formal police investigation may assign blame but for relatively minor incidents the insurance companies determine fault.

Whoever gets the ticket (citation) loses. If one was not issued why not? Sometimes, one can be issued even after the fact. If on private property - one may not issue. I try to avoid turning anything into my insurance company if at all posssible - they will make you pay later regardless of fault. They also have access to any tickets issued in the last 7 years.

absolutely. get a copy from the cops and if there is a problem with your insurance, you can show them what the police officers say about what happened.
