I don't think it's fair. The dealership should have insurance for this type of thing.

If the driver was operating a vehicle owned by a dealership, the ticket will get tossed out of court because all dealerships are required to have insurance that covers test drives.
If the driver was operating a car being sold by an individual, he's out of luck. I don't believe there's a provision in any law saying you have to have insurance "except when test-driving a car."

Here in Ontario Canada the only person that can be charged with operating a motor vehicle without insurance is the owner of the vehicle (or owner allowing the operation of the vehicles with no insurance). Perhaps the rules are different for the state/province you are referring to?
Mininum fine here in Ontario for a first offence is $5000.

If the man had an accident and there was no insurance it wouldn't be fair either.
The dealer should have insurance to cover test drives.

the dealerships carry insurance on the vehicles that they own, also, most personal vehicle plans cover newly aquired vehicles for a min. of 10 days after purchase. if the judge gets that in court, it'll get thrown out.

You should be insured if you are driving a car. Any car.
If you drive my car, and you wreck it- your insurance would cover it, not mine. Mine would only have to cover it if you didn't have insurance. Hence the term, uninsured motorist coverage.
I think if the person said "I don't have any car insurance" to the dealer, then they would have told him he could not drive. Just like a rental car company offers insurance- if you are renting a car, they want to make sure they aren't stuck with a wrecked car.
