My cousin was arrested for selling drug (hes a idiot) in Texas because of a warrant. Well he has been in for 2 months and they have issued a bill of indictment against him. Ok I always thought a indictment was a charge issued by a grand jury. But he was arrested and has been in jail for 2 months now. Don't arrest come AFTER indictments?

Here's some things I know about his case. He sold weed to a undercover police officer. The next week they got a warrant from the JP and arrested him. So why do they need a indictment if he had a warrant? To me it sound like he was charged by the JP and the grand jury.

As far as I know he is charged with the same thing. He's in jail awaiting trial and has a lawyer.

No, not necessarily. person are sometimes arrested and then the case is presented to a grand jury for indictment

Each state is different but it sounds like he was charged for two different crimes. one for possession and the other could be a number of different like- intent to sell, illegal substance near a school zone, or having a certain amount.
He needs a good attorney to help him with all this and find out if he is being screwed or not!
