When is a simple battery misdemeanor expunged in California? Is it by default, or is there a criteria for expunging. Should a expunge request be placed? What is the advantage of expunging, given that you still have a record.

Misdemeanors such as simple assault, petty thefts etc can be expunged if you apply for it 1 year after the conviction, provided that you have completed all the sentencing or sentencing alternate requirements and so on. I found some info. in the link below.

You can have it expunged. And the idiots who answered before me are wrong. The conviction DOES go away... it shows as dismissed on any criminal background check. Even federal.

It does not go away.....ever. Even if you have it expunged forms now ask about any "expunged" charges.
