I'm about to file for AOS. And i'd like to hear someone elses story on it. I just want to be prepared!

I came to the US on a K-1 Fiance Visa in 2004 and married a USC. I currently have Conditional Permanent Residency and will have to file to remove conditions in Aug.

We filed for Adjustment of Status a couple of weeks after we married, which took 13 months to be approved. The interview went very well. If you are prepared and have plenty of evidence of an ongoing relationship, its nothing to worry about.

Our whole immigration journey went very smoothly (we did it ourselves, no lawyer). The most difficulty I encountered was with the local government agencies such as SSA and the DMV pretending they knew the first thing about immigration law.

In 1997 I married a US Citizen, I am British. Hire legal help for a start! It was much easier with a law team behind us. There wasn't really any difficulties as, although we were different nationalities, we were the same age, race, background and had the same obvious tastes in music and style. This made it perfectly reasonable that we would have hooked up anyway. I think this is key. They have to see that you really are making it work as a couple. It took about six months to complete. The interview was nerve racking and the waiting room was full of desperate people wanting to know their future. However it went smoothly from there on. Just take it easy, relax, be honest and be yourself and stock up on some hard liquor!!

I am US Citizen. My wife is Filipina. We were married in The Philippines. It took over 2 years for her to get her immigration visa. After finally arriving in the US she received her green card about 2 weeks later. It's valid for 10 years. Had we been married less than two years when she arrived, she would have gotten a 2 year "restricted" green card which would have required another petition, interview, and more processing at the two-year mark. As it is, we're done with it. I'm glad we did it the way we did.

Everything you mention is for one of 2 people - 1) someone who was married to a US citizen prior to 9-11. 2) the non-US citizen had valid, legal entry into the US.

I STRONGLY suggest getting an Immigration Attorney! INS is not an easy process and you need someone who is familiar with the law to assist you. It is worth every penny!
Also, if your spouse is not in the US legally DO NOT file the AOS.
Someone I know married a Latin American who was here illegally. After they married he went back to Mexico and they applied with INS to get him legal residency in the US. They paid over $7000.00 and fully complied with every request from INS. After 4 years of waiting and living in separate countries he was denied - for NO reason at all.
Whatever your situation is GET AN ATTORNEY!

I didn't but my sister got married to a non-us Citizen, to my knowlegde they didn't have any problems.
