Depends on your local law. A law was just passed, here in south Texas, where you have to put a lane between you and the officer or slow down (geez, can't remember the amount) so many miles under the speed limit. I guess the officers are tired of getting run into. Didcha see Max X?

It all depends on the scene- If the officer orders you to not pass or go around. If the scene appears to be unsafe i would not attempt to pass I would wait til he gives the okay first. If your obstructing justice, interfering with a criminal investigation, yes. If the officer does not acknowledge you and is concentrating on the person he is pulling over I would cautiously and slowly drive by or move to a different lane away from the officer.

Georgia has such a law. They were put in place because too many police were being hit by passing motorists. I think you can successfully take the ticket to court and have it turned into a warning. But ignorance of the law is no excuse.

In most states you will be cited if you fail to slow down significantly OR pull over at least one lane to give the officer a safety zone.

Yes, you have to sit there, behind the police car until the officer decides to move. They are known to screw with people, I heard once an office just sat in his car for 6 hours just to make a stupid girl wait behind him.
