My husband overstayed his visitor visa his order of deportation is 10 years. Before he was deported I filed an I-130 to have the country recognize our marriage. He was married previously to an american and she claimed (even though they had a son together) that the marriage was fake so they denied my I-130 for that reason now I can't file another I-130 for 5 years. The lawyer told us that after 5 years because of our circustances we could get the order of deportation over turned. Together we have 4 kids he has one from previous and I have two from previous and we have one together. the two I have from previous he supported. he supported me I haven't worked since Oct 2004 we were married in mid 2005. I'm working on moving over there to egypt but before I go I really need to know that I have to wait. I need to know that there is nothing else I can do. The appel for the decision on the I-130 is already past we can no longer appel. HELP!

In my experience, there is always more to the story that ultimately directs the outcome, but check with your attorney regarding a filing for Waivers of Inadmissibility (I-601 plus evidence of family hardship).

It sounds like the attorney is correct, however, you might get a second opinion from another legal counsel that specializes in immigration law. I believe instead of filing the I-130 you should have filed the I-485.

A person can not just claim that a marriage was fake. That is why there are public records.
Find out where he married and get a copy of the marriage certificate. It is public record. Hall of records.
Get a lawyer. Quit playing with the Federal Goverment.

Call an immigration attorney.
90% of Y!A is composed of over-opinionated 13 year olds with nothing to do.
Good luck.

You've already talked to a lawyer about it. He/she is the best one to ask, so go with whatever he/she says.

Get yourself an attorney and plan to start "walking like an Egyptian."

I don't think you have many options. I would write the dictator in egypt and see if he would send you plane fare.

You need legal help not a bunch of know-nothings on the Internet.
