I ate at mexi joint and had
enchilada, burrito and taco
upset that I saw honest to jesus christ
rat poo
but owner wasn't there(manhattan)
saved evidence, is it too late?

Pretty much too late if you didn't get sick right away and go to a Dr or hospital to document the harm.

If you are trying to claim mental anguish, you would need witnesses attesting to that anguish over the three months.

But, if hadn't called the manager by now, it's hard press to claim an injury -- unless you got so sick or something you could function and follow through for three months.

You'd have to be able to prove the rat poo came from the restaurant too.

Tough sell for you because many things

Unless you have evidence that (a) you ate there and (b) the evidence you have is from that meal specifically, I think it may be too late.

If there was not an owner/manager there at the time, you should have one of the employees give you a phone number or address of someone that could have addressed your complaint immediately. Or call the Board of Health and see what they say.

Absolutely too late. Especially since Mex food looks like rat poo often. The ground beef can easily be mistaken for such. And I love the stuff.

Sounds like first you need to get a job instead of worrying about suing a restaurant. Unless you had some internal damage with proof, i.e. hospital records, you are out of luck.

If it tasted bad to begin with, why continue eating?

Too late...but post the name of it on here so nobody else goes. That oughta teach them! (PS.....send the evidence and a note to the restaurant board of health. They could get closed down).
