My opinion I would wait until insurance company accepts the claim, if you have the vehicle repaired then fight it out with other insurance company later,you are going to pay more then the company is willing to pay. Shop and Insurance companies have agrees to work at a discounted rate that is lower then a walk-in customer would have. All insurance companies pay that way. Also if you wait for the insurance company to accept liability they will cover you to have a rental car for the entire time that your vehicle is being repaired. If you are having the hard time with the company dragging it's feet contact the area supervisor you are a claimant they have to cater to you and your rights. And as far as the shop billing the insurance company before they have accept the claim, The insurance company would deny the bill since 99% of insurance company write there own original estimate of damage then the shop and the company fight the total out during the repairs. The repair shop is the one in question in my mind. They should fix it and then bill the insurance company.
You could tell the repair shop that if they don't get with the program you'll take the car somewhere else or you could have patience and get a rental car payed for through the other guy's insurance co.
Call and ask if the policy has a rental car clause.
If they hesitate to give an answer ask them if they would rather deal with an attorney which you may want get any way.

That's risky. Unless the insurance company did an estimate and you pay the exact amount of that estimate out of pocket; that's the only way that will work. If you can afford to pay it knowing you may never get it back (they deny because their investigation doesn't show their insured is at fault) then do so. But if you pay more than they say it should cost you may be responsible for the difference. Definitely make sure that the insurance company sees the vehicle before you do any repairs.

"Get an attorney- they wil fix it right away because they dont want to deal with them"- Just had to IMMEDIATELY respond to this comment- insurance could care less if you have an attorney- they will do everything the exact same way. Plus, attorneys dont deal with property damage- it doesnt make them any money- and thats all they care about.
Unfortunately, when you didnt get collision you made the choice to put yourself at the mercy of the at fault parties insurance. Somtimes, things arent as simple as they appear. Maybe they are having trouble contacting their driver or they are waiting for the police report for liability. Maybe tehre is a coverage issue. If you fix the car yourself- there is no guarantee they will pay you back as they need to do their own estimate.
Unfortunately- if you want them to pay for it- you have no choice but to wait

Well, the other guy is supposed to pay for your damages, so call them up and ask them either to pay up, or you'll go retain an attorney to ascertain your rights. They should give in immediately as they don't want to deal with an attorney. :)
