ya it would be jan 1st. my mom had that problem with me, i was born on dece 31st and she wasnt sure if i was gonna be concidered dece 31st or jan 1st... but i ended up being dece 31st. its better as jan 1st all the people partying are all out on the 31st hehe. at least thats what it always seems to be.

If it's Dec 31 12:00am, it's obviously a Dec 31 baby. If it's Jan 1st 12am, then it's a new year's baby. Notice how the time is 12*AM*? That means morning, start of new day. You don't have to wait until a minute later.
So, be in labor the day of the 31st, deliver the head at 11:59PM, and at 12AM, the next day, January 1st, deliver the body.

no matter what time u have ur baby on dec. 31 it is not a new years baby u can consider it a new years eve baby but thats it if u had ur baby on jan. 1 then it would be a new years baby.

12 am is the start of a new day. If you look at the date on the birth certificate it more than likely say Jan. 1

midnight new years eve would be a new years baby but at noon it would only be a dec 31 baby sorry
