i got rear ended in september and still haven't gotten my car fixed. my claim rep doesn't call me back i would call every day for like 4 days and leave messages. one time i called 5 times in one day to see what was happening with my claim and my claim rep never called me back and yes i did leave a message. I had to call progressive twice they said the other party has 3yrs to accept liability and they said that i might not get my deductable back. wtf!!! i was at a red light and i was rear ended. i asked progressive when was the last time they followed up with the other insurance party that was at fault? they told me 2 weeks ago. wouldn't a good insurance company follow up at least every 2 days or at least every 3 days? i am stuck here with a $8 check to get my car fixed with a damage appraised for 720+ and progressives estimate is 508.00 i am soo mad. what should i do????? I hate progressive i even told them that!!!

First you get what you pay for.
If you want faster claims service then you need an insurer that charges more in premiums.

Secondly....if the other driver's insurance was at fault....you don't even need Progressive in the picture.....

Call the other driver's insurance directly and go that way.

If the other insurer was at fault, you don't ever need to even contact Progressive.

Just deal with the other insurer.

No, subrogation usually takes a minimum of six weeks, up to two years. If you got Progressive through AN AGENT, your agent should be making these calls for you and tracking progress. Once a month calls to your agent should suffice.

If you "bypassed" the agent in hopes of getting a cheaper rate, well, you got what you paid for, YOU have to do the agent's work yourself.

The other person's insurance company has no duty to pay you, or progressive. AND they could be claiming you were in reverse, and hit THEM!! So this could well end up in court.

Now, what to to do fix this.

1, if you have an agent, call them.

2. Assuming you don't have an agent, call progressive, ask to speak to the claim team supervisor. Tell them you aren't happy with the lack of followup on the subrogation, and the response time from your adjuster, and you would like a different adjuster assigned to you.

3. Tell the new adjuster you need to get the car fixed, ask them to either 1. file in small claims court on your behalf, or ask them for permission to file in small claims court.

4. File in small claims court, and the other insurance company will probably either respond with a check, or not show up for the hearing - which would mean you win by default.

I hate to be the deliverer of bad news, but this is more common than not. Most companies claims departments are better than Progressive, but as far as your deductible it can take a very long time to get that back. I would start contacting the other party's insurance company. Tell them that you need to get your car fixed.

You can hate Progressive all you want, but it doesn't change one simple fact.....you owe your deductible!!! YOU chose to be self insured up to your $500 deductible, YOU are choosing not to get your car fixed. Progressive fulfilled it's part of the contract by paying for YOUR damages over your deductible. The fact you didn't read your policy, or listen to your agent when they discussed COLLISION DEDUCTIBLES with you isn't anyone's fault but your own. So get over it.

What you should do is this...take the Progressive estimate, WITH YOUR CAR, to a body shop. If it's a shop they are networked with, they will do the repairs for what's on the estimate. If they are not a networked shop, the shop will contact Progressive to negotiate rates for parts/labor, etc. Either way, if there is additional damage to your vehicle that is found during the repair process THAT IS ACCIDENT RELATED, Progressive should cover it. But remember one more thing....Progressive's obligation is to YOU and only YOU (which they have fulfilled), NOT the body shop. They will pay for reasonable labor rates, not some outrageous amount that inflates your estimate. So if you choose a shop that charges unreasonable labor rates, Progressive may pay them less and any difference owed on the rate is YOUR OUT OF POCKET expense. For example, there are 2 shops in town, one charges $25/hour and the other charges $75. Obviously $75 is unreasonable, and it doesn't guarantee the work will be better--it just guarantees an inflated final repair bill. Which would you rather pay?

Your claim is closed. You have turned over your subrogation rights to Progressive--it happened the moment they issued the $8. What this means is that Progressive will pursue the at fault carrier for what they paid to fix your car, INCLUDING your deductible. There is no time frame for subrogation. If they are able to recover your deductible they will return it to you. They have done their job, now do yours and get your freaking car fixed.

As far as your take on what an adjuster should or shouldn't be doing.....get over it. I have more than 100 open claims on my desk right now with multiple exposures each. You obviously don't know what this means, but let me put it to you like this....WE ARE EXTREMELY BUSY, are WAY OVERWORKED AND SERIOUSLY UNDERPAID, and put up with WAY too much b.s. from people like you, thus taking time away from more important issues, like FATALITIES, but what do you care??? You don't, because you have no respect for people in general, it's all about YOU YOU YOU, giving you what you want when you want it at the precise moment you say. When whiney people like you call me.....I laugh at them and wonder what life must be like for them.

You need to come back to reality. Progressive has NO control over another insurance company. No adjuster alive is going to call another company every two damn days for a two-bit $508.00 loss or even a $15,000.00 loss. These people have over one hundred working claims and you are no more important than any of them. People like you drive me nuts. You seem to think that the world should come to a halt when you whimper and whine...well get over yourself and get your car fixed. If it takes over $500.00 to get your car fixed and your shop can prove this to Progressive, (within compliance with the policy you purchased) they will pay. Progressive will attempt to subrogate the other company but be warned: there is NO promise that they will be successful. You may be out $500.00.

Despite your frustration and anger, try to be nice. People do not respond well to shouting and threats. In fact, they may make your experience worse. Why would I call you back, just to get yelled at again, no thanks. Politeness can carry you a long way.
