My sister had a mix up with her taxes last year, she brought in her last paystub to Jackson hewitt and based on that a bank gave her a loan that was to be taken out of her taxes (basically she just got the money quicker) anyways her boyfriend went to a different place with his W2 and they asked him for their kids SS numbers, he didnt think anything of it, so to make a long story short he ended up claiming their kids and she ended up not getting anything back in taxes (she had to pay since only one person can claim the kids) so now she owes this bank the money, she has been trying to pay it off but she is very strapped for cash, when she files this year for her refund is it legal for the bank to just take the money? ( since most of the tax preparers in our area use that same bank) She really needs her refund, do you think that they will take her money?

It depends on the fine print. Seriously---you and I know that those "rapid refunds" are bank loans, and she basically signed a contract---depending on WHAT THAT CONTRACT SAYS in that teeny tiny little printing, YES, they might be able to take her money out of this year's tax refund, because she may have signed for them to have that right.

Read the fine print.

Ps--if her refund got taken away because HE claimed the kids--what kind of refund did HE get? Hmmmm...sounds like HE owes HER some money, TOO!

I would suspect that she can not get a rapid refund from Jackson Hewitt, but if she does her taxes herself or goes to another tax preparer she would get her refund.

Yes, they can take the money. It is in the fine print of the contract that she signed......even though she didn't read it.

To Becky F........a boyfriend and a boyfriend can not file jointly. Only married people can.

Why didn't they file joint? Why did the boyfriend use he kids as deductions? Even if they are his kids...do they live together or apart? Do you think it is possible they intended on scamming the government? She is screwed, the bank will get their money. And you say she didn't get anything back in taxes...why not? Did he file before her? Why did they go to 2 different places? Sounds like they aren't together. Maybe he pays a lot of child support and figures he gets to use the kids as deductions. Since they are not married it is ballsy of him to use the kids as deductions and not ask her first. How did they file the year before? Did he use them the year before, then she should have checked with him. I think they don't want you to know they both tried to use the kids, thinking they could get away with it. A lot of people try.

No they cannot legally take her money unless they have a judgment against her. She needs to keep up her payments and enjoy her tax return.

Companies will try and bluff you into paying your last penny if they have to.
