Unfortunately you have no proof that the truck actually sent the rock that hit your windshield. You need to claim this under your comprehensive deductible on your insurance policy. The trucking company and their insurance carrier will deny any wrong doing....sorry but that's why you have comp coverage on your policy...

You can also file an official report to get it on record for your insurance.

to the guy above.

my friend had a severe accident from some ice sheets that were still on top of his rig. the ice slid off in a large amount smashing the windshield, crushing his arm and then him sliding into the guard rail. luckily all that happened was his arm being broken in a few places. the guard rail slowed him down without him swerving off of it. he said his guardian angel was out helping him hold the steering wheel so he didn't swerve into traffic.

the cops said the trucker saw what had happened and pulled over a little bit ahead. he was the first to call it in but his company paid a huge settlement and he lost his job and he might of lost his commercial license I don't remember.

the truck driver is responsible for his load no matter what it is. he is to make sure the railing around his dump bed is clean and that his load is tarped, that is a federal law. you should have stopped the driver at that time and called the dot and his company. how do i know been a truck driver for over 30 years now and have been the trucking forman of a road paving crew for over 3 years. it only takes a couple of minutes for the driver to tarp his load. i catch my drivers with untarped load they pay the ticket not the company it just laziness on thier part.

What is there to report? The truck didn't do it on purpose. The chip is the cost of doing business on our highways. Live with it. What do you want, monetary damages? You would have to prove the truck did it. How can you do that? Do you have video of the incident? The rock is out of the control of the truck driver. Do you want him to have a blemish on his record? For what? Something that was out of his control? Have some mercy.

because of these dump trucks always having rocks in the back, you should ALWAYS be heave caution while driving behind it. should give your self atleast a 3 car length distance between each other.
