shop when a litlle kid on a bike came out of a drive and hit the side of my car, thankfully he was not injured, but my car had a scratch and dent on the drivers door, the little kids bike had no brakes. it happened outside his house and mum & dad came running out. Everything was cool, exchanged details and they said they would cover the damage. I went to see a friend who owns his own bodyshop and he quoted £380, which i think is a good price, considering how much the insurance company would charge. The thing is, i rang the parents of this kid and informed them of how much it would be and they and they are saying that they want to use the insurance, does this leave me open to anything, like not reporting the accident and/or not informing my insurers / losing my no claims / paying the excess / i would rather not use the insurance as i don't want to pay any more for the insurance as it's expensive enough and they shouldn't let a kid on the street on a bike with no bloody brakes

Yup, your screwed, and I'm sure the parents know it.

Not reporting, losing your no claims, excess the works.

You still have to report the accident to the local police/authorities. This is very important for your own protection, so the parents don't come back at you and say that you were at fault. Then it becomes a "they said, you said" situation and your stuck paying for your car and a new bike for the kid. The insurance company will require a copy of the report, also. You will not be out a penny if their insurance pays the bill, and it will not go against you on your insurance. So GO and fill out the report.

i am no expert, but it shouldn't be YOUR insurance that is affected, but their own. yes, you might have to pay up front and then claim it back from their insurance, but if your friend has a bodyshop he should know the ins and outs of claiming from insurance companies. I suggest, if you have a lawyer friend, get them to go round to these people's home with you, and read through their insurance policy with you there (or better, you or your lawyer friend read it), and if there is nothing about cover for this type of accident, tell them they need to cough up some money. they might not want to do it, but for them to have an insurance that would cover for their child on a bicycle with no brakes bumping into a car OUTSIDE THEIR HOME ON THE STREET, would be a very rare event. Stick to your guns and insist it is them who have to pay up. there is no need for your insurance to be involved at all - you were not the one who caused the accident... the insurance might require a police report to pay up though...

It sounds as though you are going to have to pay the excess on this as the insurance company may claim that you were going too fast in a residential area and that you were driving without due care and attention.

That child could easily have gone under your car had they been a few seconds earlier, count yourself and them lucky that this didn't happen.

I agree with others on here that you shouldn't be so lazy and that you should walk to the shop for a paper in future!

why should you lose your no claims bonus because of their kid. This should not come from your insurance it is for the parents to pay. Tell the parents that they are free to make enquiries of other garages and get their own quotes and then choose which they want to use, as long as your car gets sorted, but that it was not your fault and you will not use your insurance as you will lose your no claims bonus. Just tell them that if they refuse to do this, then your solicitor will be in touch, if they lose this and pay for your car when you use a solicitor they will have to pay your legal fees too. They can't win.

File a claim with your insurance. Your insurance company will seek reimbursement from the general liability cover on the parents' home. Your NCB shoud be safe. And their insurance should cover your excess as well.

They should pay up, it's their fault. They might have some third party thing with their house insurance which could cover them. Alternatively tell your insurance company what has happened and let them sort it out. You shouldn't be out of pocket for this.

it is ileagal to ride a pushbike without brakes/reflectors/lights etc so if the kid is on a bike without brakes then inform the law, as noone was injured they wont be too bothered if you have left it over 24 hours to report it then you may be able to sue the parents for the damage it is not up to them who you use for the repairs to your vehicle get advice from a lawer though as you have losses they may give you a free half hour

How can they use YOUR insurance when it's them at fault. If you're fully comp then get it repaired and give them the bill. Also report it to the Police as then you will have a report number for any legal action that may happen if they don't pay.

In the US we would turn in a claim udner the parents homeowners policy. Call your agent and ask them if a homeowners policy there would cover a claim like this. If it will turn in the claim directly to the boys parents homeowners insurance company
