I had a credit account that was dismissed under bankruptcy. My Father and I have the same name. My father's credit has been severely damaged by the confusion of our credit histories. My father has sued the credit card companies for their misreporting. This credit card company is now 3rd party suing me for the amount of the account, saying that it was obtained with his SS number. All info on the account was mine, except for apparently the SS number. If the account has been dismissed, nearly 1 year ago, in bankruptcy court. Can the CC company now come back and sue me for the amount on the account?

Fight it - they cannot sue you for a discharged amount whatever the details. Just another bully-boy corporation. Tell them you'll see them in court and to expect a counter-suit when you win the case.

If you listed the debt in your bankruptcy, then it has been discharged. Any action by the creditor to collect is in violation of the discharge and they can be punished with fines and other penalties. Any local bankruptcy attorney should be able to assist you with this andy may would take a case like thing on a contingent fee basis.

Anyone can sue anyone for anything - that doesn't mean that they will get anything. Talk to a bankruptcy attorney, maybe the one who handled the issue in the first place.

I shouldn't think so, but I understand that the bankruptcy laws have changed recently. Best seek the advice of a lawyer.

talk to a lawyer, maybe you can sue em back

if its unsecured credit, I think you would win

point out your BK # and refer them to your BK attorney
