In Nebraska, can an illegal alien be granted discretionary parole from prison? The sentence was 3 to 5 yrs. for a drug offense and served 1 1/2yrs. Wouldn't he be deported upon release? Is it common to release illegals on parole?

If he has been sentenced to a felony and is serving time in prison, then the prison will notify ICE when his release date nears. ICE then will take him into custody and start removal proceedings. ICE can only release him if he is involved in testifying and they think it is necessary and he is not a threat to the public and will appear.

Depends on the states. Here in Texas, they are caught and release and make to promise to show up for their court date so they can be deported. lol Then again, if your vato is from the planet Mars, they might let him go.

I thought they deported them so that they can sneak across the border again to commit more crimes.
