You see, a few hours after the accident, the careless driver did not call his insurance company to make a claim and that it is his fault (which is very clear). So I have to wait for him to acknowledge that it was his fault so I could go to rent-a-car to be charged to his insurance. Im very busy and with his carelessness I have to deal with all this work while he does nothing to acknowledge/report this accident. I want to call him to report this accident immediately so that repair and rentals can be processed ASAP. Remember, I dont have time for this bullshit but I dont have his telephone no or address. Everytime I call his insurance company, they would say give him time to call. Well, I dont have time and I want a rent-a-car by noon... so I can sleep and go to work at night. He wrecked my car and the guys insurance say give him time. While the wreckless driver drove off with little scratch on his car, I dont have one to driver tonight for work.

If you have insurance, report it to your insurance in writing, and then get the car fixed. Let the insurers fight about it. It helps if you file a police report, regardless of how much damage.
You could be screwed, cause he will just claim its not him, he wasn't driving and on an on...hopefully you have a witness..

His insurance company has to get statements from both parties, look at all of the facts of the claim before making a determination whether they are going to make a payment (wouldn't you want your own insurance company to make sure you are at fault for an accident before making out any payments?) You should turn in the claim to your own company if you need to get your car taken care of immediately. So long as you have collision coverage, your own company does not have to investigate the claim before getting your car fixed, they will take care of it right away. Call your company and turn in a claim.

Insurance companies are in the business of making a profit. Your company doesn't want to pay you even though you've been paying to them for however long, nor does the other company want to pay. Once you have turned in a claim, the onus should be on your company to collect. Don't forget, they are not on your side. The absolute best thing is to contact a lawyer and get them involved the lawyer's profit comes from a percentage of the settlement they get you, therefore they are going to get you the most they can as quickly as they can and with as little effort as possible. The two insurance companies are stalling. Go after them!

You should be calling YOUR insurance company, NOT his! Let the insurance companies sort out fault.
