I am due in feb. My job is not offering me marternity leave just my position once i return. i know you can get it through the state. How does that work does anyone know? and how much they give you and how long you have and so on

First, federal law states that you must be given 6 weeks unpaid leave. California law states that these six weeks will be paid (they are considered disability). You need a form signed by your doctor stating your leave (also, in California, you are paid for 4 weeks before the birth). After your 6 weeks of disability are done, you then qualify for another 6 weeks (your spouse will also qualify for these six weeks, but they cannot be at the same time) with the Paid Family Leave Act. It states that you are given 6 more weeks paid to bond with your baby. It DOES NOT state that your company must hold your job for you (unlike the disability). Both pay about 2/3 of what you make currently.

There are also forms you need to tell the state. You can get these forms and all your questions answered at www.edd.ca.gov (the employment development division)

Wow, we here in Canada get a 1 year maternity leave. Our job is protected for the year and we get 55 % of our pay. We could also take an extra year without pay but have a job in that company. We are very lucky. I couldn't imagine leaving a 6 week old baby. I can't believe they think that a child could grow up properly when left at such a young age at a daycare. I'm proud to be Canadian.

On September 23, 2002, the governor signed legislation that will allow employees to take partially paid family leave beginning after July 1, 2004. This paid family leave program will allow workers to take up to six weeks off to care for a newborn, a newly adopted child, or ill family member. Under this new law, employees will be eligible to receive 55 percent of their wages during their absence, up to a maximum of $728.00 per week. These contributions will begin in January 2004. Unlike the unpaid family leave program that exists under the California Family Rights Act, all employers are covered by this legislation, not just those with 50 or more employees. However, also unlike the unpaid family leave program, businesses with under 50 employees are not required to hold a job for a worker who goes on paid family leave.

California has a law protecting women who are disabled during pregnancy—the Pregnancy Disability Leave Law. This law allows women to take up to 16 weeks of leave for a disability related to pregnancy, childbirth, or a related medical condition. Pregnancy Disability Leave Law is different from leave under the Family and Medical Leave Act (FMLA) and the California Family Rights Act (CFRA). In fact, in California, more employers are covered under Pregnancy Disability Leave Law than are covered under either the Family and Medical Leave Act or the California Family Rights Act. This is because all California employers with at least 5 employees are covered by Pregnancy Disability Leave Law. So, even if your employer tells you they do not offer FMLA or CFRA, you may still be entitled to time off from work to accommodate a pregnancy related disability.

Depending upon the size of your employer and other factors, after you take time for a pregnancy related disability, you may be entitled to an additional 12 weeks of leave from work to bond with your newborn child. This means some women may be entitled to up to 28 weeks of leave if they have a pregnancy related disability and then choose to take time to bond with their newborn. You should consult an attorney or other knowledgeable professional to determine the various types of leave that may apply to your situation and the ways in which these laws interact.

The family medical leave act is where you will usually get monetary benefits why you are on maternity leave. It is kindof like unemployment. I used this during my maternity leave and it worked out perfect. Plus you usually can get extra time and your spouse can use it once the baby is born to take time off with both of you to bond. Check out the website below for all the facts. Your job is no way in jeopardy, with this act it is illegal for you to be terminated for leave. Also, you can use any sick leave you have on the books for your maternity leave and then start the family medical leave once it runs out. They have to give it to you it is the law. Good luck.

You should talk to your Dr about getting the forms you need to apply through the state for disability. You get up to 12 weeks total. 6 weeks is considered family bonding time and the other 6 weeks is state disability. But your Dr. should have all the information and should tell you when to file.

your employer is already paying for disability insurance and unemployment insurance as overhead on your salary. because of that, you are eligable to receive disability insurance (but not unemployment) and then california also has "paid family leave".

the easiest thing is to go to your local EDD office and they will give you the correct paperwork to fill out for the disability insurance which you can collect for up to 6 weeks and the paperwork for paid family leave (another 6 weeks) will automatically be sent to you after that. or, again, you can go to the EDD office and pick up the form. note, you will have to take the forms to your doctor so he/she can sign and verify.

rates change and you will have to report the "earnings" on your taxes the next year.
