No, your son's father would not have to be head of household to claim your son as a dependent, and to claim the child tax credit. You can give him a written statement that you will not claim your son and that he is allowed to. The easiest way to do this is probably to download form 8832 from irs.gov, fill it out, and give him a copy. This form applies whether or not you were ever married.

Yes - He can claim him especially if he paid more than half of what you make annually in child support. He would be a dependent because he would be able to demonstrate that you did not provide over half of the child care and expenses. however, the catch is you can not claim your son on your return. If you do red flags go up.

Do each and all of the above, plus touch your community MP and if Inland sales isn't efficient, threaten them with GMTV - there's a persevering with run of thoughts of Inland sales incompetence on the teach and that they consistently get a Gov't Minister to tackle your subject

Usually the divorce or custody decree will say who can claim the child on the tax returns. You might want to make sure what yours indicates before you claim him or not.

If no one else is claiming your son then yes but he'll need proof most likely. I pay for my kids health, vision, dental, etc. and i buy them stock in my employee stock plan but i can't claim them because they lived with their mom most of last year so she's claiming them.
