3. The site would be the one going to jail. Not you.

What I would be worried about is the viruses that come with it.

I understand Claire, but explain to me how do you use it for illegal purposes? It's not like I'm burn a freakin CD and sell it.

Ok so why would WE get fined? Wouldn't be the users? They are the ones uploading the music.

Ok okay. SO the thing is illegal. Then why does everyone in the world do it? This in a way helps the artist (in my point of view). The people are getting these songs right and if they like the artist they can go out and buy the whole CD and they would get quality sound. All of this is making Limewire sound like "Oh if you use limewire then your gonna go to jail one day!"

Now I bring up bearshare. I went to their site and on the home page it said Legal P2P. Is that true?

LimeWire is a P2P file sharing program and as such they do not have any of the files on their servers.
Downloading music and movies without paying is theft plain and simple. It is the same thing as if you walked into Best Buy and took a CD or DVD without paying for it. Music, movies, books, and art are all copyrighted materials.
When the fines are levied it is against both parties, the downloader and the uploader. You, the downloader, gets fined because you are downloading materials you know you would have to pay for if you walked into a store to get the same item. The uploader is fined for making copyrighted materials freely available to the public. The only reason a fine wouldn't be levied against either party is if the uploader can prove that they own the copyright to the materials in question and are making said materials freely available to the public.

The program itself isn't entirely illegal, as someone hash already said, there is a page when you first get into it that says 'I will not use limewire for illegal purposes'. Most people just click that, and keep going. Yes, the viruses are a concern, but that is not the worst it gets. Some people have actually had problems with identity theft after they used it. But because so many people use limewire, it's impossible to catch everyone. As to why Limewire has yet to be shut down, I don't know, but I'd say they're getting to it. Those programs only last for a bit before another one comes out and outdates the others. I don't use the programs, for some reason it just never worked with my ipod. I don't think people are entirely 'afraid' of being caught, though. You go into a highschool, or any place, and you can hear people talking about it. You go to a police officer and tell them you're using limewire, and I doubt they're going to arrest you for it, or even fine you.

Many people have already been fined for downloading music illegally. The software people get around it by putting up disclaimers saying that their software should not be used for illegal copyrighted material. By downloading music for free, even if only for personal use, you are robbing the musicians and everyone else involved in producing the music of the money they are entitled to because they are trying to sell it. Downloading songs is no different than shoplifting a CD from a store. Musicians make music to sell and you are stealing it instead of buying it.

It's not the site that would be shut down necessarily. They have a disclaimer when you download it that makes you say 'I will not use this for illegal purposes'. This basically gives them a get out of jail free card. Millions of people use it, that's why it's so hard to catch people. People do get sued for downloading illegal music and programs. If you are downloading copyright material, you are at risk of being caught. People have been caught and I have even received a letter about it in the past telling me to get rid of what I had.

The software itself is not illegal. users share alot of files that are legal, the problem is when you share music, videos, or programs that are copyrighted or illegal to share. The software developers can get blamed for what you besides, the program offers and option of paying for music, its up to you if you pay or not.
about the viruses, it is very easy to disguise a virus as a song, video or software. make sure you have your antivirus enable and updated.

Because it isn't a site. Its a network. When you install Limewire, you join the network. The site www.limewire.com has NO illegal files on it. The illegal files are brought to the network by users who join it.
So thats why you will get a fine and not the site.
