Is there anyone out there that has received a kidney transplant that was infected with CMV (cytomegalovirus)?
My husband did and was not told about the virus and within 21 months he has Died. He was hospitalized 11 times in the 21 months. Has been an unreal nightmare.
Isn't there any regulation that requires hospitals to inform that the donated organ was positive for CMV, sadly he was not?
Should the risk have been disclosed and given him the chance to reject the organ transplant?
I am totally devastated at the loss of my husband at the age of 57.
In Texas, there is a Statute of Limitations of 2 years and frankly I did not realize that CMV would cause him to die. This last hospital stay was for 55 days.
A kidney donation should be a gift of life - not a nightmare as it was with my husband's transplant.
Anyone with legal or personal info..Please respond.
I would like to change this practice so that recipients are made aware of the risk they are undertaking and the consequences.

You need to speak to a good medical malpractice lawyer ASAP. CMV is easy to test for. I'd want to know if I was getting a potentially deadly infection. I think you may still have a case because the two years may not be applicable or may have started at the date of your husband's death.

They can't replace your husband but you should be compensated for your loss of his company, your medical bills and the pain and suffering you both had to endure. sorry

That is a truly terrible thing... God bless you and your late husband.

I don't know that anyone here will have an answer for you, it sounds like you really need to talk to a lawyer- or perhaps several of them. Find one that specializes in medical malpractice cases... Sometimes you have to talk to a whole bunch of different attorneys to find one interested in the case.

My personal opinion, for what it's worth is that they absolutely should have let you know in advance of the transplant and someone really screwed up at that hospital... The fact that it was infected with cytomegalovirus should be relatively easy to prove with existing documentation, so at least you're not in a case of 'he said she said' when it comes to proving what they did.

I couldn't just sit around and do nothing like my doctors suggested.

They didn't want me to do anything or to take herbs or herbal remedies, but I had to try something - they just wanted me to do dialysis!

This program allowed me to take control of my health. I went from Stage 4 to Stage 3 kidney disease.

It was easy to do and my BUN, creatinine and anemia are all in better ranges.
