It's unclear whether or not you are a minor (under 18) or simply under the drinking age (21). Either way, you ABSOLUTELY AND DEFINITELY CAN SUE!!! You should not be at all worried about the fact that you were underage. Legally, the bar is responsible to be screening IDs. Even if you went in under a "fake id" - they have a legal responsibility to catch it. If you looked underage, they should have asked you for a second id. School Ids etc. hold no legal muster - the bar should have required a driver's license or state alcohol id with YOUR picture on it.

Regardless, they have a responsibility for ANYONE who gets injured on their premises. That's why they are required to maintain general liability insurance, to cover events like this. If you were OF AGE - you wouldn't think twice about filing suit. The fact that you're underage only looks worse for them. Sounds like the bouncer or bartender really wasn't doing his job. You should also be suing whoever threw the beer bottle.

If you're under 18 - it would be even better. Your parents can sue on your behalf. I suspect that the bar will settle with you and you won't need to go to court. Good Luck!

Thats the problem with this contry everyone wants to sue and dosn't want to take responsibility for their actions. I have been to many bar since I've been of age, and many citys and neighborhood and I can say I've never been hit with a beer bottle or been in a fight. I go to the bar to have a good time not to be an a$$hole

Underage in a bar. Most likely a fake ID. So you're going to have to explain all that to a judge. The bar might be on the hook but the person that assaulted you is liable. You have a better chance of suing that person. Was there a police report? If there is you have a chance. Talk to an attorney.

I would say you would have the right to sue the person who hit you with the bottle. I am not sure if you can sue the bar though but it's a good possibility since they let you in and you are underage.

Think about what you are asking here. Own up to the fact that you should not have been there. It's like suing your drug dealer because he stole your money that you intended to buy drugs with. No court in the world would give you your money back. What are you really trying to get out of suing the bar? A free ticket to life? Chalk it up to a bad experience and move on.

Okay, here's a wacky thought.

Did you think of suing, oh, the guy who cut your arm? You scammed your way into a bar underage, you were enough of a big girl to drink, but now that you see some money in it you want to retreat to being a kid.

You were irresponsible and your scamming could cost a bar owner his livelihood. Even some server making most of her income in tips could get shafted.

Why don't you just take those 37 stitches, call it a life lesson and practice some responsibility?

Finally.

well i see at least 3 things here about your behavior that are illegal
1. you are under age in a bar
2. you probably got in the bar using a fake ID
3. you were drinking
yes you could probably sue the bar owner and/or the person who hit you. you would need to talk to a lawyer about that
but likewise the police could charge you with being underage in a bar drinking, and using a fake ID?

I doubt if you have a case for the following reasons:

1. You don't belong in a bar if you are underage

2. If you are dumb enough to go into a bar where fights break out and you got hurt it is your own fault

Grow up and take responsibilities for your own poor choices, babycakes. You can't expect other people to pay for your stupidity.

Actually you would likely win based on the fact that you were admitted to a bar as a minor. Be sure you tell your laywer this, and enjoy the settlement!
