- Any other expenses, my husband doesn't work he only get's SSI because he is disbled but he owes the IRS a large amount of money should i include him as my dependent?

A spouse can't be a dependent. If you file joint, you'd get an exemption for each of you, but then any refund you have coming would be grabbed for his debt. You could probably get the part of the refund that's due to YOUR earnings and withholding back by filing an injured spouse form, but that could take time.

If you file as married filing separately, it's likely to cost you extra taxes.

Your best bet is to adjust your W-4 with your employer so you don't have a refund coming next year. If there's no refund, there's nothing for the IRS to grab.

I realize that doesn't help for the return for 2006. Injured spouse form could help though.

I can assure you, however, that if you file married filing jointly and your husband owes back taxes to the IRS your chances of seen any type of refund are nil to Zero. Your refund will be deflected to pay his debt... The IRS sees your refund as community property... Goes without saying: check a person's financial affairs before marring him/her...more so in a community property state. consult a tax professional for further details...
