Like the first poster noted: you can check and see what your neighborhood/or city noise ordinance is.
I'd also talk with the neighbors nearest you and see if this bothers them, and if so, how they deal with it. Or see if they want to circulate a small petition (only after talking with the guy first.. he could be hard of hearing and not even realize all the ruckus he's making).
Until then, you might be able to sound-proof your home a little bit.. or play soothing nature music.. drown the noise with 'white noise' such as a fan, humidifier, etc...or wear some sort of soft ear plugs to bed (like some people do with sleep masks).

This can be a difficult situation, as your neighbor is really doing nothing wrong (unless there happen to be noise ordinances in the neighborhood that specifically regulate this). My suggestion, to keep things amicable, would be to take your neighbor some nice baked goods - cookies, a pie, a cake, or something - as this might be something he isn't able to enjoy often as a retiree and may not feel like making for himself (you don't mention his marital status). Then let him know that you really appreciate the way his yard always looks good, but that because of your schedule, if he could do some of the louder chores later in the day, it would be more convenient for you. But be sure that you can let him know your qork schedule, or something to really back you up on the sleep issue, because retirees may see you as a "slacker" if you just tell him you want your "beauty sleep." Wish I could help you, it's hard to approach anyone and not wonder what will happen. You might be able to say its great that you have so much energy but would it be possible to keep the noisy chores till a little later in the morning. Most older folks do get up before sunrise but my house in FL is more older folks and I made friends first and suggestions later. In NY I have neighbors who frequently have parties till 3 am or so ... I want to talk to them but seeing as how they're in their 20s I figure I can expect more than just cigarette butts to come flying over the fence and onto my driveway, seeing as how they're not even considerate of the tenants around them (they're in a house apt) but its a neighborhood with houses) I figure I'll see if anyone who responds to you comes up with somethng we can both use ... good luck sorry this got so long

First thing I would do is see if the town you're living in has any noise ordinances. There might also be some sort of neighborhood organization you could go to or perhaps see how your other neighbors feel about it. A neighborhood letter to the gentleman might do the the trick. Good luck.

i would see if there are other neighbours who have a problem with him about the noise and ask if they ever aproched him about it. see what that gives you.
i would also just ask him kindly during a normal talk with him about his yard, how nice it looks and all and slowly say, you up bright and early working hard i noticed to get this yard looking so nice, but i was wondering if you could kindly start the noisy things a bit later and start with the not so noisy things, maybe even try to bribe him with a nice cup of coffee you made or better home made cookies, soup or cake??? to bring to him while he is out there working??? just sweeten him up. ask him this twice or three times but at the third time warn him by saying, i have tried to ask nicely sir but next time i feel i need to call the law on you. I have had that problem here myself and it worked for me.
goodluck, i know how annoying people can be.

If your neighbor is accustomed to getting up early and doing chores, he is unlikely to be able or willing to change his routine. Your best bet is to buy an inexpensive sleep sound spa or other white noise apparatus and muffle the sounds. When a family moved in next door to us and began sitting on the patio late at night, speaking and laughing loudly, I had a hard time adjusting. But like your neighbor, they were doing nothing wrong so the problem and its solution was mine.

because all the smells intertwine when they cook and smell good. it's not hard to make food smell good. it's harder to make food taste good. my neighbors are full chinese i believe doubt they came from America but their house is a total pig sty. theirs crap they bring home from work all over their front yard and back yard and it's all broken things like tables, fridge, washing machines,etc.. but from time to time when they are cooking it smells really good. but i highly doubt it tastes that good. why? just walk infront of their door step and you will understand why theirs craps everywhere including dead plants/animals decaying like fish. Im sure they don't shop at a real grocery store either but the local china town and everyone in my state knows the china town isn;t very good for groceries as it's been known to carry rats and it isn't even that tasty. that being said don't let the smells fool you.
