I got a DUI a few weeks ago @ the San Ysidro border crossing. I was actually still in Mexico and did not know your officially in the U.S. once you cross some line. I always assumed you were in the states once the inspector checked your ID and let you in.

The only reason I drove was due to my friend not feeling comfortable driving in Mexico, so I drove to the border line, and as were waiting a SDPD officer came to me and asked me to meet him once I crossed over. Has anyone ever gotten out of a DUI case and what was your situation? Thnaks

Ah I wasn't drunk at all, I just had a lot to drink through out the day. I passed there field test. I wasn't even driving in Mexico we were going about 1-2 mph! I think they just wanted to meet there quota for the month and they get whoever they can get!!!

I am not a lawyer, but I think you got setup. I live in San Diego and have never heard of this. Though I have not traveled in Mexico in the last 15 years (very unsafe at this time), you should not have been approached by a SDPD officer unless you were on US soil. If you passed the field tests and your breath test was less than .08, you should be okay. If you are under 21 years, you could definitely have some trouble for using a controlled substance (alcohol). If you are considered legally under the influence, just having the keys in the ignition will get you a DUI.

Hell yeah you can beat a DUI in CA. First thing you need to do though is request a hearing with DRIVER SAFETY for your license or you'll loose it once that pink paper expires. YOU ONLY HAVE 10 DAYS hire a lawyer to do it right. You can't really compare your situtation with someone elses. It will depend on what is written in your report. Andwhat your Alcohol Level is. Oh yeah but if you are going to talk to an attorney make sure they are a DUI specialist and ask them exactly what they'll do for you before hiring them. Remember it'snot like bying a shirt on sale hire someone that's worth it (if your worried about it) But DUI's in CA are a big deal so handle it correctly.

If you failed the breathalyzer, you're up the creek. If not, the DA shouldn't even file charges. Regardless, you need a lawyer.

Btw, you have the right to demand a blood test for alcohol level instead of the breathalyzer. You have to pay for the test, but if you are borderline, this can give you a couple more hours to sober up as they find someone to administer the test. But, NEVER DRIVE DRUNK. Even if no one is hurt, look at the crap you're going to have to go through now.

I'm sure someone, somewhere in CA, has gotten out of a DUI.

You shouldn't be driving drunk regardless of the circumstances. You're friend's a moron for asking you regardless of his chickensh*t reason. You deserved it.

Hey, if you blew .08 or over, you WERE legally drunk. Get a lawyer, it's your only chance.
