How should we file our taxes? Joint or separate, or does it matter and if he didn't make hardly any money at all, can I claim him in anyway? Also he finaly got a job and worked in December but his boss didn't take out taxes what do we do about that, will we get in trouble? HELP I'm soooo confused!

Filing jointly will usually give you the lowest taxes, but not always. You can calculate it both ways to see which is better for your particular situation. If you file jointly you get an exemption for each of you. If you file as married filing separate, you can't claim him for an exemption.

If your husband got a paycheck in December and his boss didn't take out any taxes, then it sounds like he's classified as an independent contractor. This would mean that he's responsible for paying his own taxes, including 15.3% for self-employment tax which is social security and medicare - he'll pay that with his tax return. If he's an independent contractor, he'd get a 1099 instead of a W-2, showing his income for the year.

just to expand a little on some of the other answers - Most married couples do better with married filing joint, but I have seen a few cases where married filing separate was better. If you go to a tax preparer they can usually calculate married joint vs married separate...and I think some tax software will do the same. If you are doing your tax return by hand you might do 3 tax returns (married filing joint, married separate for you, married separate for him) and see which is best.

You will probably end up filing jointly, that makes for the biggest refund. You cannot claim him as a dependent; you will get an exemption for him and for yourself by filing jointly. It's ok if he didn't have any taxes taken out as long as he didn't make TOO much, like under $2,000 is ok.

You can go out to turbotax.com and using their online software get a feel for what your taxes will look like. Their software will automatically tell you if you get a bigger deduction by filing joint or separate. It's free to use as long as you don't file.

File Jointly as it is usually the best way.

Was your husband and "employee" or an "independent contractor"? Contractors do have taxes taken out.

File joint girl. if he did not make much money then you should get a nice return because your taxable income was low in relation to the number of people in your family.
