Do you have joint custody? if not, you will have to fight for custody. She might have had a will or other papers filed saying that her mother had legal guardianship if she was ever incapacitate. You need to talk to the grandmother, and nicely, and find out. No matter what, you need to be there for the child NOW. this is a traumatic time for her.

Have you been an active parent in this child's life up until now? Do you have a good relationship with the grandmother? I think you need to put the best interests of your daughter first. With her mother dying, she is obviously pretty traumatized. Continuity and stability are the best things for her. You ripping her out of her home doesn't sound like the best thing, unless the grandmother is unfit. I suggest you build a close relationship with the grandmother, continue to build a relationship with your daughter (assuming you have been doing that all along), and re-evaluate the situation later on.

Off you go to get a family court lawyer... today. No one on here can give you an accurate answer to your problem, it varies from state to state and how your divorce decree reads if you have one that gave the mother custody in the first place. Good luck..
ps- try and remember it's about what's best for your daughter, not about you.................... so many parents seem to lose sight of that.

You have rights to your daughter. The mom is brain dead, what good can she do now for the child.
call dcf and see the procedure of getting your dauhter back.

does hell yeah! mean anything to you? if your daughter's birth certificate has you listed as the father you have every right to her.
has there been a divorce? were you granted visitation? if yes then you will probably have to take it to court, if not and you two were only separated then take an officer over to "grandma's" and retrieve your daughter. right this minute! the longer she is there the harder it will be to pry her away from the grandmother.

go get her. as much as people say it ,grandparents dont have rights!! supreme court ruling. are you guys married? if so you dont have to go through the courts. who has custody?? if there is no custody order , i would just go pick her up.
