Hi everyone. My fiancé is an I-94W visa holder and I am a US citizen. His visa expires in the middle of next month and we are getting married. Can anyone give us a brief rundown of the necessary steps, forms, etc. to get married and change his status to resident? I wanted to hire an attorney to help us with this, but they all seem to be very expensive here in New York ($3000ish for attorney fees plus $900 for USCIS filing fees).

You would need to file an I-130 Petition for Alien Relative.

You should be aware though, that since you are getting married from a tourist visa, if the I-130 is denied, there is no option for you to appeal the decision since marrying on a tourist visa with the intent to immigrate is not techincally legal. The K-1 Fiance Visa was created to limit these types of applications.

You will need to be able to prove to USCIS's satisfaction that when your fiance entered the US on his tourist visa that he had absolutely no intent to get married and stay in the US, that is was a spur of the moment decision after his arrival.

1) Don't forget Form I-693, which you the USCIS doctor should already have. You will need to file this along with the I-485. Also you will need a police clearance form from every country you have lived in for 6 months or more. This is required for Form I-485 also. 2) No problems, but as Fred stated, don't leave the country until you have the green card in hand, since you will be considered to have abandoned your adjustment of status. 3) There is the help line which Fred mentioned, but they can be quite vague and they are known for giving misinformation which they are not liable for should there be a mistake. There are many immigration forums out there to help.

Just go to the immigration office and get papers. I know this is a hassle because they treat you like crap but it is better than paying 3000 dollars.
