Most employers will do everything in their power to provide these to employees soone than January 31st. But many things can complicate this process, most notably the year-end accounting processes that are being undertaken at the same time.

Federal law requires that the W-2 statements for the preceeding year be sent out by the end of January. Failure to meet the deadline may bring fines from the IRS. Also, employees who file early may be forced to re-state their taxable earnings if they do not receive the W-2 in time.

by Jan 31st, is the mandatory due date per the fed gov. If they are going to be late , the comp. needs to let employees know by the 15th of Jan, and they will require the comp, to pay a fine, it is a big one, so most comapnies are never late. This of course means the companies mail them to you , no later than Jan 31st before midnight.
