Probably, if you are doing it for profit. If you are doing it just for yourself or something else not involving business, you should get by with it.

technically yes it is a breach of copyright.
if you are creating a painting based on but not a direct copy you can and should at the very least add somewhere may be onthe back of the painting make reference to the inspiration behind the finished painting.
words to the effect" this painting was inspired by (this picture, seen on or in here)" maybe attach the original or a copy of the original however seek the copyright holders written permission first or you could end up with a law suit one day if someone owning the copyright to the reference material spots the connection then who ever owns the work could end up with the fine.
i may be wrong and i hope i am, but is it not better to be safe than sorry.

Wow. If I had a boyfriend I wouldn't dress up like that anywhere. Heck, even without a boyfriend now I don't dress up like that! She's obviously an attention seeker. If I had a boyfriend I'd dress up nicely or casual, but not to the point where I look like I'm in a bra and underwear. I'd rather wear a cute dress or on comfy days a nice pair of jeans and a cute top/sweater/jacket on top. Yikes. Not booty shorts and a cloth on top. -.-

Yes, it is infringement.
But you can use the cutout illustration in a mix media piece -- montage -- and paint over it. As long as you use the original. A copy of any ilk is considered infringement.

No. Copyright violation only applies if you are using your artwork for some commercial venture, like reproducing it for dress patterns of your own, stationery, etc.. Interpretation of a copyrighted design in art is allowed under copyright law.

Possibly technically, but it depends how you use the image. If you made 10,000 the same and just ripped off their idea for commercial purposes, then yes. If you are making one or two fine art paintings then I really doubt anyone will mind.
I don't recall Andy Warhol getting sued by Campbell's Soup. I wouldn't worry about it.
