I have been threatened with a wage garnishment for a 20 year plus student loan and I was under the assumption all my student loans were paid off. But whats really strange this company has my married name not the name I used in school at that time and someone elses social security number. Can they garnish my wages using my name only

If the social security number is not yours then they have the wrong person. You will have to go to court on this one. You have to appeal this decision in court and present your case. Good luck. If you don't correct this properly thye will hound you forever so get to it!

The loan company/collection agency cannot just garnish your wages, they need to get a judgment against you beforehand. First, dispute the account in writing, as soon as possible. Send them a letter through certified mail explaining the situation and saying that it is not your debt. Send this, not only to a collection agency (if that is who got your student loans), but the private loan company itself. If this ultimately does not work, then you may have to lodge a complaint with your local/state Attorney General's Office, where you can fill out a complaint form against the bank that offered you the student loan. The Attorney General's Office will then mediate between you and the bank, trying to get you restitution.

The first thing you need to do is find out if this debt is valid. You say you paid it off, and it's someone else's SSN. The debt is probably not even yours.

Under the FCRA, any company that says you owe an old debt must show you PROOF of that debt. Simply write them a letter like this:

"According to my rights under the FCRA I dispute your claim and request validation. My student loans were paid in full years ago and the social security number of the debt in question does not match mine. Please provide proof by sending original copies of the debt that match my name and social security number. If you continue to contact me about this debt I will contact the attorney general's office to notify them of this violation of my rights."

No one can garnish with out taking you to court. Also depends on what state you need to get more info on the company and ask them to prove it is your loan. If you get summons go to court if you fail to show up you will receive a default and get garnished.

when it comes to student loans, they can do ANYTHING they want to get the money from you. They can sue your estate if you die, you cannot bankrupt against them..ever!.

You will pay, might as well suck it up and work out a payment plan with them.
