I am stopped behind a car wanting to turn right into a driveway. I manage to get around the car, however a car on the opposite side of the road (crossing my path) has driven into a driveway, and as a result i have clipped his back tyre as he was entering the driveway. Is he at fault for failing to give way to oncoming traffic?? Or am I for hitting him?? Thanks

I believe you are at fault. If you had clipped his front half it would have been his. I'm not getting a clear picture here of how your accident happened. Are you saying he turned left in front of you? Did you pass the car in front of you by pulling into an oncoming lane? If the car infront of you is turning right and the oncoming car is making a left turn and you whip around the car in front of you that is turning right and clip the rear end of the oncoming car that was making a right turn (his right) then you are deffinitely at fault. You may have right of way but if someone is in your way you do not have the right to ram them.

Sir, you were behind a car, that is turning right!
You decide to go around the car, that means you changed lanes!
When changing lanes, the driver leaving one lane to enter another is TOTALLY responsible to insure that the lane is free of any traffic to a degree that the change can be made safely without causing any endangerment to traffic already in that lane. In fact, entering that lane should not require breaking by any of the traffic already in the lane!

You are at fault!

If the vehicle in front of you wants to turn then you must wait until he turns before proceeding.Lots of drivers use the wrong signal by accident therefor causing even a larger crash when you decide to pass. You are clearly at fault

You're at fault. Your best option would have been to stay stopped behind the first car and wait for it to turn into the driveway.

The powers that be will probably say that you should have waited for the guy in front of you to turn. When you went around him, you pulled into a lane that is going the other way.

i t would be his fault if the line between the opposite lanes is stright yellow lines then hes not suppose to make tat turn even if its a dashed yellow line u still have the right of way

they,ll consider it your fault if you hit them,,even though it may not be,,but the way the accident happened will probably make it go against you,,,some times the laws on these things aren't right but we have to live with them,,good luck hope this help,s.happy new years.
