He would not be welcome back into my home until he made major advances in getting himself clean and remaining in a drug free mind set. Look you need to help him now.
He is going to tell you he fine and might even get mad at you but if he gets the proper help he will be thankful. You don't want him hurt or in jail. It sounds like he is an addict.
Eventually he will not be given another chance with rehab or whatever.
First I would go to him and ask/ tell him (depending on the type of relationship you have with him) he needs help and needs to go back to rehab. If he refuses then talk to your mom ~ his friends (only ones YOU can trust) but last thing I would do is call the police. Talk to your mom or an adult YOU completely trust.

If your brother is over 18 your mother should put him out of her house.
If he's under 18 she should get him some help and in the meantime you should lock up everything you own because he will continue to steal whatever you have.
Having a drug user in your home is like being a prisoner....I'm sorry this has happened to you.

Get him into an inpatient treatment facility... Well, actually, your parents should! Tell them what's up. Insurance will cover treatment, and there are places that he won't be able to check himself out of. If he was court ordered to go to treatment, then let him know that not completing it will land him back in jail... that should be a motivator.

Time for tough love! Tell him he can't come to your house until he straightens up. Tell your mother that she is not helping him by making excuses. One day he will do something at the wrong time and place and get hurt --would she want that on her conscience?

Pray! Pray! Pray! Your brother must don't want to be help sounds like he do what he needs to in order to get out of trouble, but once he get his freedom then he goes back to doing his deed. I know it must be hard on your mother, but I have had siblings (brother and sister) on drugs, my mother had to turn them loose until they came to grounds to wanting to help themselves.
