It depends on which state you're in. If she's underage then yes, you can be arrested for statutory rape and become a sex offender for the rest of your life regardless of whether she "consented" or not.

If you are in any of the 50 states of the US, then yes, if her parents pursue it, you could be arrested and charged with Statutory Rape. I personally don't think there is a big difference between 17 and 18 but I wouldn't want my 16 year old daughter with an 18 year old guy, it's a matter of experience. At 18 you aren't interested in holding hands and going to the movies, obviously, no mother would want their daughter having sex with anyone let alone an 18 year old man.

The answer to your question is yes, but only if someone reports you. So you need to find out how her family feels about you first. When I first met my first boyfriend that I had sex with he had recently turned 19, and I was going to be 17 in a few months. We ended up being together for 5 years and having a baby because everyone was cool with it. So that's what you need to find out. If the family does not see it as a problem then it isn't one, but if you guys sneak and do it you could be charged with rape out of there anger, and think about it do you want that kind of charge over your head just to get some ***. I know you gf probably means more to you then a piece of ***, but do you think the cops will care. My advice think long, and hard first, and get a feel for the family if you guys are really serious about each other. If not move on. Good luck.

depends on the state.
Ohio they consider under 18 a minor but also state that consenting sex is allowed at 16.
But even if she consents, and the law says she can, the parents can still step in prior to 18 and press the statutory rape charges. And they will stick even if she says nothing happened cause she is a minor and they are her legal adult parents.
More or less.....don't let her parents find out you guys are doing it, don't let her keep a diary or book stating it all (mine did that and hung my balls 1 yr later), don't let her go telling all her friends, etc. And stay on the parents good side at all costs.
Otherwise.....tag the booty...cause the booty only gets flabbier and looser the older you get (sigh)

If you are in California, yes. Legal age is 16, as long as both partners are under 18. Otherwise legal age is 18. As far as the 16 legal age....if you are over 18, it is ONLY illegal if her parents complain. Parental approval makes it legal...but that is a magic wand you are better off not giving someone, any misstep and they can waive it putting you in jail.

Here is a link to a list of states and their legal ages in the U.S.
http://www.coolnurse.com/consent.htm
I suggest you read everything that's posted as there is some good answers as well about the law.
I am not sure if the laws have changed since that was posted, or how old the post is, so when in doubt...it's a good idea to check more than just one resource.

No, you will not go to jail because she is 16 and 16 years old is the age of consent in most states in the USA.

depends on what state you live in. states differ in "age of consent" laws and also what's considered as statutory rape. i'd review your state's laws before you do anything. i did jailtime for doing the same thing. but if i'd done it just 50 miles away across the border in a different state, it would've been okay.
