My boyfriend and I are getting married next month and I'm not a resident. I just wanted to know if anyone's gone through the process and can point me in the right direction.
Thank you :)

If you want to come in and then get married, your fiance can file for a K-1 fiancee visa. That takes about 6 months and you must come in and get married within 90 days after you enter the US.

As long as you are in the US legally in another visa category, or came to the US legally and then overstayed your visa, you are eligible to adjust status in the US. Once you get married, your spouse needs to file I-130 visa petition (along with I-864 affidavit of support). You have to file I-485 adjustment of status application. It will probably take 8 months or more to get approval for a conditional green card. The conditional green card is good for two years, then you and your spouse have to go back to USCIS and apply for a permanent green card. If you want to work in the US, you can wait to get your green card or you can file I-765 work authorization request with your I-130 and I-485. The work authorization will probably be approved in about 90 days.

First of all its illegal to come to the U.S. with intentions to get married without a fiance visa (k1). But if you come here without a fiance visa and the two of you decided to get married on the "spour of the moment" u are forgiven by law. That wont make u a legal immigrant though. You will have to file the paperwork for Adjustment of Status (it is also mandatory to have a series of medical tests and vaccinations with that) , they will fingerprint u and give you an interview with a immigration officer. The whole process usually takes 6 months 1 year after you sent the paperwork. If everything is ok they will send u a conditional greencard (2 year greencard). 90 days prior your second marriage anniversary you can send in the paperwork for a permanent greencard. As for the citizenship it will take 3 years from the day you received your greencard.
The adjustment of status process will cost you around 1500 $ in forms and medical expenses. It would be cheaper if you dont want to file for the work or travel permit (if you dont file keep in mind that u wont be able to work or travel outside the us till you receive your greencard though). You can find the procedure step by step here www.visajourney.com
good luck

This is such a pain in the butt process. There is a few things I can suggest get all the papers filed and get what you need before you get married. It's so much easier that way, I waited until after we got married and it's been a pain in the butt, we had to show proof we loved each other and it wasn't a marriage based on getting to the USA etc. You will need to apply for a k1 visa here is a website you can go toohttp://www.uscis.gov/portal/site/uscis to to take care of everything.
If you can hire a lawyer fees it will be around 1500 to 3000 depending on the lawyer. Best of luck.

We need a bit more information, such as are you already in the US on another type of visa, or as a visitor, or are you still in your country?

If you are alread in the US on another type of visa (other than visitor visa) you would need to file an I-485 Adjustment of Status to Permanent Resident.

If you are in the US on a visitor visa or VWP you would need to file an I-130 Petition for Alien Relative.

If you are still in your country, you can either file for a K-1 Fiance visa and marry in the US, or marry first then file for a K-3 Spouse Visa.

This is an excellent site for information on marriage visa:

If you are mexican, have your boyfriend knock you up, so that you can have a anchor baby. This way you can get welfare, WIC, free healthcare and all the other benefits mothers of anchor babies receive.

Happy New Year!!
