A persons appearance or ability to speak English cannot tell you if that person is here illegally. Neither can the length of their presence here. English is not a requirement to get a green card, only citizenship. People may be here legally under a variety of immigration plans including:
* Asylum
* Refugee
* Temporary Protected Status (many people from El Salvador, for example, have been here on TPS for a decade)
* Diversity Visa (aka the visa lottery)
* Family sponsorship for a green card

answers to your questions:

1. Sure they could tell you, but they could lie to you as well.
2. Special Paper....they have something like that it's called a work authorization.
3. Of course they couldn't, coz if their visa expired and they decided to remain in the US illegal once they leave the country INS wont readmit them back in.
4. Depending on the visa i.g. seasonal workers can stay for 6 month and go back.

There are forms that poeple need to work in the US. A social security card is one and most places require a government ID...driver's license or state ID, or a work or college ID, but you can't get the latter two without a state ID or passport or birth certificate. To work in the US..even in a MacDonalds, you need 2 pieces of ID. A visa or green card are government approved ID's.

All i can say is that sooner or later we will find out in the long run when certain groups of people in this country decide enough is enough and take matters in their own hands,and dint think it wont happen.There are peaceful groups and not so peaceful groups that are waiting in the wings,and they aren't going to care how you tell if their legal or illegal.
